Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) form a legally binding agreement between your business (“Client”, “you”, “your”) and AFzDigital (“we”, “us”, “our”). By purchasing a service package, enrolling in a monthly maintenance plan, or submitting our qualification form, you agree to these Terms in full.

2. Services & Productized Scope

AFzDigital provides productized technical engagements designed to enhance digital presence, local rankings, and site health:

• Digital Presence & Visibility Foundation ($299 one-time): Complete Google Business Profile audit & map pack optimization, local citation repair across tier-1 directories, website Core Web Vitals speed tuning, and foundational Schema.org entity verification.
• Local SEO & Google 3-Pack Package ($299 one-time): Targeted geographic relevance engineering, primary trade category configuration, citation alignment, and local review acceleration blueprints.
• AI Search Visibility & GEO Package ($799 one-time): Advanced brand entity modeling, Google Knowledge Graph alignment, deeply nested Schema.org JSON-LD injection, LLM crawler tuning (GPTBot, PerplexityBot), and 20+ prompt benchmark simulations across ChatGPT, Perplexity, and Google AI Overviews.
• Website Care & Continuous Maintenance ($149/month): Proactive software updates, daily offsite backups, 24/7 uptime monitoring, security hardening, and fast unlimited minor content/copy edits. Operational delivery schedules, emergency response times, and task definitions are governed by our Service Level Agreement (SLA).

3. Project Timelines & Fulfillment

Every project has a defined execution window:

• Standard Setup Delivery Timeline: 10 to 14 business days.
• Timeline Trigger: The timeline begins on the business day following receipt of required client access credentials (e.g. Google Business Profile delegate access, CMS admin login, or DNS records).
• Final Deliverable: At project conclusion, you receive an executive action summary detailing every technical fix applied, ranking benchmarks, and long-term maintenance instructions.

4. Client Responsibilities & Credentials

To achieve optimal project execution, you agree to:

• Provide timely, secure administrative access or delegation to necessary platforms (Google Business Profile, Google Search Console, website CMS, or domain DNS).
• Provide accurate operational information regarding primary service areas, phone numbers, and trade specialties.
• Maintain active hosting and domain registrations throughout the engagement.

5. Intellectual Property & 100% Asset Ownership

You own all your digital assets completely and unconditionally.

• You retain 100% ownership of your website, domain, Google Business Profile, citations, and content.
• All custom Schema JSON-LD code, configuration files, and written copy produced during the project become your exclusive property upon payment.
• AFzDigital will never hold assets hostage, lock access, or insert restrictive licensing into client websites.

6. Search Engine Reality & Performance Disclaimers

We adhere to strict white-hat, guidelines-based search optimization:

• Execution Guarantee: We guarantee the rigorous, accurate execution of all agreed technical deliverables (e.g. Schema markup, citation cleanup, GBP category alignment, Core Web Vitals optimization).
• Algorithmic Disclaimers: Search engines (Google, Microsoft Bing) and AI platforms (OpenAI, Anthropic, Perplexity) operate proprietary, autonomous ranking algorithms subject to continuous, unannounced updates. No ethical digital presence agency can guarantee a permanent #1 ranking or specific revenue outcomes.
• We are not liable for algorithmic turbulence resulting from broad core algorithm updates, third-party profile suspensions triggered prior to our engagement, or manual penalties caused by previous black-hat SEO work.

7. Fees, Invoicing & Payment Terms

• One-Time Packages: Setup packages ($299 or $799) are billed as a fixed flat fee upfront prior to project kickoff. No hidden fees or unexpected billings.
• Monthly Plans: Monthly website care ($149/mo) is billed automatically on a recurring 30-day basis via credit card or approved payment gateway.
• Currency: All fees are stated in United States Dollars (USD).

8. Cancellation & Refund Policy

All services, technical deliverables, and digital products are governed by our comprehensive Refund & Cancellation Policy:

• Digital Products & Setup Packages: All purchases of technical packages and digital deliverables are final and strictly non-refundable due to the immediate, non-returnable digital nature of technical assets, audit reporting, and custom Schema code. If you feel any deliverable does not match the agreed scope, we rigorously revise and remediate the work at zero additional charge under our scope execution guarantee.
• Monthly Website Care: You may cancel ongoing monthly maintenance at any time prior to your next renewal date with written notice to [email protected]. There are zero cancellation penalties or termination fees. Previously billed periods are non-refundable.

9. Limitation of Liability

To the maximum extent permitted by applicable law, AFzDigital’s cumulative liability arising out of or related to our services, whether in contract, tort, or otherwise, shall not exceed the total fees actually paid by the Client to AFzDigital in the three (3) months preceding the claim.

AFzDigital shall not be liable for any indirect, incidental, punitive, or exemplary damages, including loss of profits, data, or business opportunities.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. In the event of any disagreement, both parties agree to engage in good-faith informal negotiations before initiating formal legal proceedings.

11. Modifications to Terms

We reserve the right to modify these Terms to reflect changes in our service models or legal obligations. Active monthly clients will receive notice of material changes prior to renewal.
